Terms of Use

These conditions govern every visit to Montgomery County Criminal History, including use of its content and search tools. Accessing or continuing to use the site means that you accept all terms below. If you do not agree, stop using the site. Government websites and third-party services reached through external links operate under their own terms, which you should review separately.

NO FCRA USE. This privately operated site is not affiliated with a government agency and is not a consumer reporting agency. Neither its content nor partner tools may be used for credit, employment, tenant, insurance, or other Fair Credit Reporting Act decisions.

1. What This Website Is

Montgomery County Criminal History is a private reference resource with no ties to Montgomery County, the State of Texas, or any government office. It neither stores official criminal records nor retrieves, certifies, or files them.

The site directs readers to custodians such as the Montgomery County Sheriff's Office, District Clerk, County Clerk, Texas Department of Public Safety Crime Records Division, and Texas Public Sex Offender Registry. It may also connect visitors with outside search services.

2. Rules for Using This Site

By using the site, you agree not to:

  • Violate any federal, Texas, or local law
  • Threaten, stalk, harass, or unlawfully discriminate against another person
  • Use site information for an FCRA-regulated decision
  • Attempt unauthorized entry into systems or accounts
  • Deploy scraping, bot, or other automated traffic against the pages
  • Interfere with site performance or another visitor's access

3. No Harassment, Stalking, or Discrimination

Information found here or through a linked tool may not be used to intimidate, threaten, stalk, harass, or unlawfully discriminate. The restriction is especially important for Texas Public Sex Offender Registry data. Texas Code of Criminal Procedure Chapter 62 governs the registry, and public access does not authorize vigilantism or any crime. Registry information is for safety awareness.

4. We Are Not a Consumer Reporting Agency

Montgomery County Criminal History does not create consumer reports, credit reports, or official background checks. It is not a consumer reporting agency under the FCRA. You must not use site content or a linked tool to:

  • Make a credit or lending decision
  • Screen a job applicant or decide continued employment
  • Evaluate a renter or other housing applicant
  • Set eligibility or pricing for insurance
  • Decide a license, permit, or government-program benefit
  • Carry out any other action governed by the FCRA

A legally required official process must be completed through the proper Texas authority or a compliant consumer reporting agency.

5. No Legal Advice

Site content is general information, not legal advice. It cannot determine how a Montgomery County charge, warrant, case, expunction, or order of nondisclosure applies to a particular person. Consult a licensed Texas attorney for legal advice.

6. No Warranties

The site and its contents are offered "as is." No warranty is made that:

  • Any page or linked result is complete, current, or error free
  • The service will remain continuously available
  • The site will be free from bugs or security risks
  • A partner search will find or correctly match every relevant record

Government records change when charges, dispositions, corrections, expunctions, and nondisclosure orders are processed. Verify all information with the office maintaining the original file.

7. Third-Party Services and Links

Links can lead to Montgomery County agencies, Texas portals, courts, and private search companies. The operator of each destination controls its content, fees, availability, security, and data practices. Montgomery County Criminal History has no responsibility for those outside services. Their own terms apply after you leave this site.

8. Intellectual Property

Unless otherwise identified, site text, graphics, logos, and code belong to Montgomery County Criminal History or its content partners. Copying, modifying, republishing, or distributing that material requires prior written permission.

9. Limits on Our Liability

To the fullest extent Texas law permits, Montgomery County Criminal History is not responsible for losses or damages arising from site use, inability to use the service, reliance on its content, or use of a linked provider.

10. Indemnification

You agree to defend and hold the site harmless from claims, demands, actions, fees, and costs caused by your use of the service or your violation of these terms.

11. Governing Law

Texas law governs these terms. Public access to Texas government records and criminal-history dissemination is governed in part by Government Code Chapter 552 and Government Code Chapter 411. Any dispute about these site terms must be brought in a court with jurisdiction in Texas.

12. Changes to These Terms

These terms may be revised. A new version takes effect when it is posted on this page, so visitors should review the current text before further use.

13. Cutting Off Access

Access may be restricted or ended at any time, without advance notice, including when conduct threatens security, availability, legal compliance, or another visitor's use.

14. Severability

If a court finds one provision invalid or unenforceable, the remaining provisions continue. The affected term will be narrowed only as much as needed to make it enforceable.

15. Questions

Questions about these terms may be submitted through the Contact page.
